KRIS DAVY: ATTEMPTED VANDALISM OF SURVEILLANCE EQUIPMENT / 30 JUN 2015

On 30 jun 2015; Kris Davy sprayed RAID pesticide on the front porch where Johns' cats sit during the day; spraying it near the cats food etc. (Kris has done the exact same thing in the past; and this past incident was reported to Officer Jason Neilsen. > see KRIS DAVY: INCIDENT #EV 15118 237 | VANDALISM + PROPERTY THEFT ETC link below)

Angry that John washed down the porch to remove the dangerous toxins from around the cats; Kris then attempted to vandalize Johns' surveillance system once again; and this time with the garden hose. After an extended and unsuccessful attempt to destroy the camera with water; John saw what she was doing and intervened. Kris is clearly an out-of-control 'pesticidal maniac' who needs to be restrained and punished somehow for her bad deeds.

Question: If RAID pesticide cannot be disposed of in the garbage here in Sunnyvale due to its' toxicity; WHY ARE PEOPLE STILL ALLOWED TO SPREAD IT AROUND THEIR PROPERTIES!? In fact; many modern pesticides are essentially derived from diluted nerve agents developed during WWII in Nazi Germany!?!

NOTE: IG Farben had bought the patent for the pesticide Zyklon B, which had been invented by the Nobel Prize-winning Jewish-German chemist Fritz Haber's research group at the Institute for Physical Chemistry and Elektrochemistry in the 1920s, and which was originally used as an insecticide, especially as a fumigant in grain stores. IG Farben licensed the pesticide to various companies, including the American Cyanamid Company for use, for example, in de-lousing incoming Mexican immigrants in the 1930s, and to the German company Degesch (Deutsche Gesellschaft für Schädlingsbekämpfung), founded by Fritz Haber, and whose products were used in Holocaust gas chambers. Adding to this; Kris also unplugged surveillance camera #1 on 1 Jul 2015; causing a re-direction of the camera; locked one of Johns' cats in an extremely hot garage before John rescued her on this same day; then ultimately retaliated against John by ordering a non-organic pesticide company to douse the residence with more dangerous unwanted chemicals on 3 Jul 2015; instead of using Orange Oil as John had discussed with his father. (UPDATE / 4 July 2015: it turns out Kris lied about the exterminator showing up on Friday. Kris is also a compulsive liar).

THE BOTTOM LINE: Dangerous non-sustainable pesticides and/or herbicides need to be taken off the market due to their dangerous toxicity; and the federal government should force the corporations who create them to start developing newer, safer products that do not cause cancer etc. For instance; how many pallets of carcinogenic Roundup are being inadvertently dumped into our waterways?

QUESTION: If Kris attempted vandalizing surveillance cameras at Sunnyvale D.P.S (for instance); she would likely be arrested; and/or if a minority youth did the exact same thing they would likely be arrested as well. Part of John's message to Mr. Struble was "You will (likely) be charged with attempted vehicular manslaughter. 1) The first time John called the Sunnyvale D.P.S. after being attacked in the street was back in December 1998. Three Sunnyvale D.P.S. officers responded; and Mister Struble corroborated the story when he was called at work by Officer Discher. A few days later; John was given a temporary restraining order from Officer Beninger; who never spoke to Officer Discher about the event. 

When Officer Beninger was asked whether or not he spoke to Officer Discher; he responded with "Who's Discher?' The female judge in charge of the case was suspicious of Officer Beninger; suggesting that this was instead a "neighborhood matter". 

John had the heavily redacted 911 readout and an email document from the City of Sunnyvale (see photos above); but never showed it to the judge due to coercion and intimidation on the part of the Strubles. Officers Smith and Ochoa violated Johns' civil rights by ordering John to leave the Oasis Nightclub without pulling up surveillance footage showing John being attacked in front of the club by Doug Ward. 2) The second outstanding incident in question occurred when Mister Olenak was laying in wait to attack John at around 6 AM one morning. John fed the ducks across the street where he had for many years; and was then followed back to his house and attacked by Mister Olenak. 

John called the police and was treated by the responding Officers as if he did something wrong; even though John had worked with both cities to install the duck crossing signs on his street; and had even gotten permission to feed ducks from now ex-Santa Clara mayor Judy Nadler. To make a long story short; an administrative hearing was scheduled where Mister Olenak admitted to attacking John in front of an entire room full of witnesses; including Officers Pablo Lopez and Gabrielle Seagrave; and Judge Louis Amadeo Junior -- who took no action to bring justice to this unusual situation. Note: Tom Foley was used as a "witness to duck feeding" at this particular hearing.

3) The third outstanding incident in question occurred after John filed a complaint against the City of Santa Clara and/or Pablo Lopez for a wrongful arrest in June of 2006. John was almost ambushed on Thunderbird Avenue coming home from karaoke a few days before receiving an official rejection letter from the City of Santa Clara regarding this event. 

This harassment and stalking and menacing continued for a number of years after this event until the June 2011 incident where John attempted to bring an end to it; only to have Sunnyvale D.P.S. mischaracterize the incident and attempt to wrongfully criminalize John once again -- causing a continuation of the harassment and stalking of John. John attended yet another bogus hearing for a restraining order even though John was clearly the one being harassed.

LAW ENFORCEMENT; GUN CONTROL AND TASERS

BACK IN THE YEAR 2004 John was delivering magazines in Mountain View, California when he came upon the above note taped to newspaper racks. For some reason when John returned home there was a San Jose Police Officer driving down Johns' street (John lives in Sunnyvale). This SJPD Officer was traveling way out of his jurisdiction; making John suspicious of this Officers' presence in his neighborhood. Was the presence of this SJPD Officer just a coincidence?

Regardless of this particular Officers' intentions (and regardless of whether or not this blog post is seen as applying to Johns' case); the main point of this Addendum Blog post is to shine a light on the use and/or abuse of Tasers that are currently being used to replace guns by law enforcement. In their own way Tasers seem to be just as dangerous and harmful as guns; therefore new restraint methods must be developed to reduce injuries to suspects during police apprehensions.  

Adding to this; cops should not be playing judge, jury and executioner on the street while others linger for years in lockup appealing their death sentences. This lacks due process and essentially amounts to cruel and unusual punishment.

Perhaps wildlife restraint methods can be further developed and applied to human restraint methods; because at this point in time out-of-range mountain lions cannot be shot in California -- so why can humans still be shot? It's high time to rethink policies regarding human rights as well; and realize that gun control should be mainly applied to law enforcement.

OUTLAW DUCK FEEDER?

After John distributed roughly 10,000 flyers around his neighborhood regarding the questionable sale of the Peterson Middle School field (which never happened -- as John successfully stopped the local corporate machine politics process dead in its' tracks); and/or after John attended two 2006 Sunnyvale City Council meetings regarding this subject (and Santa Clara City Council meeting as well during the 1990s); John then became a target for violent retaliation by local government forces. 

1) The first attempt at destabilizing Johns' valiant activist efforts (and/or paying John back for speaking out about important subjects that are in the public interest) occurred when 'undercover' Officer 'Peck' (see photo below) was laying in wait for John to feed ducks (which ex-Mayor Judy Nadler gave John permission to feed) at the corner of Wood Duck Avenue and Benton Street. Officer 'Peck' looked and acted like some sort of freakish criminal sex offender and/or carjacker; causing John to flee the scene like any normal person would.  

'Peck' later continued stalking and/or harassing John on Wood Duck Avenue; kicking in his drivers' side door in the process and causing more than $700 dollars in damage. 

(Question: why would anyone question someone feeding ducks on a street called "Wood Duck Avenue"? Wood Ducks used to actually live in trees along Calabazas Creek before unchecked development decimated the local ecosystem).

2) The second attempt to retaliate against Johns' valiant activist efforts occurred when Lake Terrace resident Tom Foley was laying in wait for John on Wood Duck Avenue. (see photo below) Tom Foley followed John to his residence after this incident; then continued stalking harassing and menacing John for a number of weeks after John had reported Mister Foley to the police. 

Tom Foley was later used as a 'witness to duck feeding' at a sham City of Santa Clara administrative court "mob sit down-style" trial where Mister Olenak admitted to attacking John in front of Judge Louis Amadeo Junior; Officers Pablo Lopez and Gabrielle Seagrave and everyone else in the court. This event was covered up as no arrests were made for this violent unprovoked attack by Mister Olenak; who was used as a 'witness to duck feeding' at this same sham trial.

3) The third egregious violation of Johns' civil rights occurred when Pablo Lopez and another unnamed Officer made unlawful orders; then wrongfully arrested John outside of his residence on 14 Jun 2006; injuring and/or bloodying John up in the process. (see photo below) But not only were Officer Lopez and the faceless unnamed Officer present at this wrongful arrest; but several Sunnyvale Police Officers were also conspiratorially laying in wait just around the corner from Johns' residence as well (as obvious payback for John speaking out a Sunnyvale City Council meeting a few months before). And while Officer Lopez had a note from the Lake Terrrace Apartments; he had no warrant for an arrest and no crime was being committed at the time. (Note: Police Officers cannot make an arrest unless they view a crime in progress and/or have a warrant for arrest). 

Furthermore; the City of Santa Clara then revived an antiquated law regarding caged or fenced animals (the ducks John feeds are free range animals; not caged or fenced) back from the 1950s when the agricultural industry was being forcefully shut down here in the Santa Clara Valley; making way for the corporate-controlled anti-environmental Silicon Valley. 

But the problem is; people now legally possess chickens in their backyards all over the Santa Clara and/or Silicon Valley; therefore this weak and/or ultimately distractive argument has all but flown the coop. And the fact remains that Johns' civil right$ were egregiou$ly violated; as violence and/or intimidation and/or coercion were used in this highly questionable activist control process.

> 20 may 2006 / THE RETURN OF ROAD RAGING JACKASS 3 (RRJ-3) - on february 27th, 2006 RRJ-3 approached my vehicle while i was getting out to feed the ducks at the lake terrace apartments...he pretended to act like a cop around a time when the media was talking about false arrests being made by police impersonators, so since he had no uniform i turned my wheel to the right and attempted to leave, and he jumped in front of my vehicle...not knowing whether this guy was some kind of crazy car-jacker or what, i turned my wheel to the right again and attempted to leave, but he jumped in front of my vehicle again, so i put it in reverse and escaped down the street backwards, turning around near peacock court...

i came back and took this photo of RRJ-3 just to document the event because i knew this guy would probably be trouble again down the line, and sure enough i was right...here we are three months later and as i was going to leave duck food on my friends' property where it is legal to do so, out of nowhere jumps RRJ-3...i quickly got into my vehicle and he attempted to keep the door open like he was going to attack me, so after forcefully throwing him back about 4 feet with the door (much to his surprise - i could push him 10 feet if i wanted) i slammed it shut and locked it...

i said "what the fuck is the matter with you!?!" and he went ballistic and kicked my door panel, doing about $1000-$1500 dollars damage to my vehicle...i then went home and called the police and the first traffic officer came and heard my story then left to go find RRJ-3 as yet another officer showed up to hear my story again, and he seemed like a pretty good cop...i told him about how i had been contacting the SCPD professional standards division complaining about their lack of action regarding crazy tom and how they told me the lake terrace people just want less food left and how i was attempting to comply with these requests by leaving the food across the street on property where i am allowed to do so, etc...

the next cop was initially cool then kinda went bad on me after the initial traffic cop showed back up on the scene...RRJ-3 denied kicking my door and committing malicious vandalism, and i had no proof or witnesses of this attack (other than my bent-up door panel) because for the first time in weeks i did not have my digital camera and pepper spray cocked and ready to defend myself, so the cops just warned him and let him go...i drove by on my way to the chiropractor and RRJ-3 was sitting on his fat ass on the ground talking to the cops looking guilty as sin with his fat girlfriend at his side...

after visiting the chiropractor i came back to my friends' house across the street from lake terrace and got them to come outside an play some catch on the street with a football, something i will now be doing alot more of in the future, as i refuse to limit my civil liberties for terrorists in any way shape or form...after a while the manager of lake terrace drove up and told me that the owner doesn't like the ducks anymore and he is paving the pond over in june!?!...i told her that the local ducks have an imprint on this neighborhood and the lake terrace property and/or the area around my residence in particular, as the city of santa clara installed duck crossing signs on my street back in the environmentally-friendly 1990s...and! even if they pave the lake terrace pond, the ducks will still return every spring anyway...

anyway; back in the mid 1990s the duck population was much bigger than it is now, so i do not see what the deal is; the flock is smaller now but healthier and more pure mallard than interbred duck as they were before...there are still some interbred ducks, just less of them...

and people have been feeding these ducks for years before me, so they became dependent on humans long before i came into the picture...there is a serious lack of available territory and/or habitat for the ducks, so all they can do is forage through the neighborhood, and there simply is not enough available food for them; thus supplementary feeding must occur - either that or the creation of additional habitat...

another thing nobody ever discusses is that these ducks are somewhere in between wild and domestic, as there is no official category for them, and this has happened because humans have so destroyed their original habitat and so paved over the santa clara valley and so ruined the riparian system of rivers that the ducks are being literally squeezed out of existence and/or becoming dependent on humans to survive...i saw the environmental disaster at 1333 lawrence expressway unfold a few years back and this simply cannot be allowed to occur again.

NO SPEED HUMPS IN ANTIOCH

"While the parents of hit-and-run victim Timothy Hudson were burying their son at a local cemetery Monday, a crew of city workers and police converged onto the site of Hudson's death to remove illegal speed bumps the family says was placed to prevent another tragedy..."

The above story is a 'good' example of the kind of heartless and/or negligent behavior practiced within irresponsible local governments on a regular basis. This is the exact same kind of bullshit runaround John experienced (and/or is still experiencing) with the City of Santa Clara regarding speed humps that were never installed on Dunford Way. Increased traffic calming measures were promised to Johns' neighborhood by the City of Santa Clara at a meeting during the late 1990s -- but the City of Santa Clara never came through with their promises. 

THE BOTTOM LINE: Government has grown increasingly obsolete and/or unable to fully accommodate the basic needs of  their increasingly large constituency base; more often than not serving themselves and/or their monied interests first before others. Therefore; drastic changes must be implemented to help them overcome their acute cranial/posterior syndrome.

5 feb 2006 / VERBAL ASSESSMENT - a city council meeting regarding the peterson middle school field was held in the sunnyvale city council chambers on tuesday january 24th 2006...among many verbal interjections, i made a comment around the end of the meeting regarding the british parliamentarty system of governance...the parliamentary system allows for free expression throughout the proceedings, allowing thoughts and ideas that would otherwise be ignored or forgotten to get through and become part of the 'mass consciousness' so to speak, and i believe that this produces a better end result...this system needs to be applied to american politics everywhere from city council meetings to the US congress...

there are no rules when it comes to the political process, as the sky is the limit - so by 'wrongfully' interjecting my ideas during the council meeting in a parliamentary fashion, i made my voice rise up above the relative silence and added a much needed dissenting perspective to the proceedings...i see medea benjamin doing this kind of stuff all the time, and she has definitely influenced me...medea has been thrown out of countless government meetings for mouthing off and muckraking in general; thus i almost got thrown out by otto lee at the end of the meeting...

but you know; if the SCUSD can poison a protected species and suffer no recourse, why should i be worried about exercising my unalienable rights?...not worried about it...let's put it this way; i have many asian friends and i do not mean to be disrespectful but - maybe otto lee should move over china for a year then come back and see if he still wants me to shut up...i think we need to take 'decorum' and forcefully throw it out the window...

one should not be afraid to express one's outrage, and if i broke any rules, well - i didn't see any rules displayed anywhere, did you?...and besides; some rules are meant to be broken if their implementation breaks other rules which may supersede them (like the first amendment, for instance)...many in government really do not want us to speak completely freely at hearings because it just gets too messy and they can't always get what they want; they cannot fully control us and therefore the political process...maybe they prefer us all to be a bit mentally constipated like them...

unfortunately i see the first amendment as a BIG wide open door allowing all of us to do and say pretty much whatever we damn well please, as this was the original intent of the amendment - but some in government would obviously beg to differ...oh, and by the way; i recently found out that some of my ancestors came over on the mayflower to start this country, so i take this 'first amendment' stuff seriously... 

anyway, i see the city council proceedings as being very similar to the highly controlled atmosphere of court rooms, churches and schools - and let's just say while i respect the establishment of organized religion, i am not a big fan of the post-newtonian era of order first imposed upon organized religion - then to the rest of society later on...there is supposed to be a separation between church and state... 

just as one man's treasure is another man's trash; evolution to one person can often spell devolution to another; as this 'new' newtonian universe appears to be somewhat limited if you look at it sideways...newton only explained the basic physics of a falling STATIONARY object, not a falling SPINNING object - a falling, spinning object travels and/or falls farther and at a higher rate of speed than the falling stationary object (see: richard c hoagland 'hyperdimensional physics @ http://www.enterprisemission.com/) and if this is arcanely applied to politics, then the order imposed upon society at large by the post-newtonian judeo-christian tradition was in a sense unnecessary restraint, and could in fact be an impediment of sorts; as in a sense stationary suggests stagnation while spinning suggests progression...american democracy has been in a constant state of flux since 1776, and this will not change anytime soon...the only thing that never changes is that things will always be the same...

mister barnes from the SCUSD was saying something about dogs on the peterson field and kids being in danger (yeh right) etc etc etc - the usual 'what about the children!?!' nonsense...it is one thing to 'protect the children' - and another to use it as an excuse to get what you want, and i think the SCUSD and the government in general is beginning to use the 'what about the children' thing to violate everyone's rights and get whatever the hell they want at every turn... 

it used to be that elvis and his shaking hips were a 'threat' to the children, then the beatles and/or john lennon, (etc) now anything and everything any paranoid, neurotic parent wants it to be falls into the same dangerous category as elvis and the beatles; janet jackson's breast; howard stern; twisted sister; etc...so how is all this neurotic overprotection of children through mind control of others and/or censorship really any different than the actions of oppressive north korean leader kim jong-il?...

(both republicans and democrats use the 'what about the children' thing to violate individual 'unalienable' rights; and republicans often use terrorists as an excuse to violate individual rights as well, so that in a sense puts children on the same level as terrorists when it comes to manipulating those around them)...

well, i've got news for you all; i used to play with my friends in the patrick henry/peterson field when i was a kid, and there was a pack of wild dogs who roamed just behind a fence inside an area where old farm equipment was stored (right where the condos adjacent to the peterson tennis courts now are)...we used to taunt them, then run over and jump up on the monkey bars to escape them...they would eventually go away, and none of us ever got bit...so, if i never got officially attacked amidst all that, the kids nowadays have nothing to worry about, trust me; because the dogs that are walked on the peterson field now are all pretty tame...people worry too much nowadays about everything and nothing if you ask me...

back in high school i had a friend name kip bautista who could literally ride a wheelie all the way from home to school without having his front tire touch the ground, so seeing all these kids with bicycle helmets seems a little wimpy to me - sorry about that!...as a kid i wiped out, got thrown from my bike and fell on my head with no helmet a couple times, and i'm just fine...

the most amazing thing about all of this (besides having a zit on my nose the night of the city council meeting and still going on camera anyway - and the fact that i still get zits) is that i actually dropped out of peterson high school way back in 1978 or so...i'de have been happy if they bull dozed the school back then, but i have changed dramatically since and want to save the school as it was then...and let's face it; since lik roper sort of attended peterson high school with the class of 1981, it should be considered a historic site, should it not?... 

at meetings' end i still had no idea what the outcome was, because those city people speak in legal double speak on purpose to confuse us all...all i know is this; now that the honorable lik roper has officially entered the picture, sunnyvale politics will never be the same...it looks like the peterson field will be spared for now, but the neighborhood must remain vigilant to ensure its' preservation as open space, so STAY TUNED...

and just remember; the peterson property was once slated to be the future location of the amusement park 'frontier village, but the neighbors successfully fought the plan - and the patrick henry property was once targeted to be a high density housing complex, and the neighbors stopped that as well - SO WE CAN DO THIS PEOPLE - WE CAN STOP THE SCUSD FROM SELLING OFF THE PETERSON FIELD!... 

i think we have been focusing on the wrong parcel; if any land is sold to a developer, it should be the acreage which consists of the tennis courts and part of the parking lot that is 85% empty most of the time anyway...middle school students to not drive yet, so the space is not needed...

and i question the $200,000 price tag of land upkeep when it comes to field maintenance...they should open the books, show us the costs behind everything and allow us to create a low cost solution to solve the problem...i have at least five people willing to volunteer for field maintenance, but the SCUSD doesn't want to talk about it...and! if part of the land was dedicated as wildlife habitat, then it would costs little or nothing to maintain, as ecosystems pretty much run on their own once they get up and running...

oh, and i talked to a girl who said that the city of sunnyvale IS NOT the one to call if you need to report animal abuse - she said santa clara county is much better in dealing with this kind of thing, as sunnyvale is reknowned for being half-assed when it comes to animal protection...apparently the county is helping to protect wild animals by ignoring most complaints coming from residential areas...people often want to build on or move into areas that are smack dab in the middle of a complicated ecosystem, and animals within those ecosystems must be protected to ensure their survival and future population recovery...

(SEE: 'CHECK OUT THIS TRAFFIC CALMING DEVICE' STORY BELOW) - 20) WHAT ARE THE TRAFFIC TOLERANCE LEVELS OF OUR NEIGHBORHOOD? - 21) WHO ARE THE IDIOTS IN CONTROL OF ALL THIS CRAP?...etcetcetc... 

i did this same kind of thing at a santa clara city council meeting a few years back, and they bumped our next neighborhood meeting over to a tiny isolated room so i would not be on camera at the next meeting; a form of damage control...that mean-spirited city council member bitch patricia mahan gave me the most EVIL look i have EVER gotten from ANYONE while i was speaking, and in a HUGE violation of my unalienable civil rights; i was WRONGFULLY threatened with arrest the very next day!...ms. mahan was focusing her dark energies on me with a vengence, but i cut through the mustard and got my message through anyway, obviously much to her chagrine....they're all just lucky i didn't sue their pants off!...

i strongly suspect that the city of santa clara refuses to patrol our street for speeders (our end of the street is santa clara jurisdiction, not sunnyvale, you jokers down at the sunnyvale police department!...get your shit together!) and/or place any permanent traffic calming measures because of this; MY DISSENT (patricia mahan is now mayor)...why would that anonymous santa clara traffic engineer have told me the holdup on the traffic calming on our street was 'a political one'? (see: apolitical holdup' story below)... 

the bottom line is this: the government often makes people pay for speaking out by DOING NOTHING when they need help, while corporations pay for their influence through campaign contributions etc...some pay for what they say; others pay to play...anyway...

furthermore; let's look at the facts, people - we all know that everything from: 1) the reduction of global warming gases through stepped-up industrial constraints and/or increased enforcement of current environmental regulations; 2) to the protection of carbon sinks and/or forest canopies through increased forest protections; 3) to the protection of wildlife habitat and/or biological diversity - is essential to the protection of our planetary homeostasis and/or the future of the human race - so let us not take this 'environmental protection' stuff lightly...

> 30 dec 2005 / WHAT HAPPENED? - i talked to a neighbor friend today and got the scoop on the december 14th hearing at sunnyvale city hall regarding the peterson middle school field; 1) apparently the SCUSD has offered the 8 acres of land in question at the reduced price of 45% off the original price of roughly 3 million dollars per acre plus the cost of inflation, but - 2) the sunnyvale planning commission has recommended against the sale of the land (partially due to the large amount of neighbors against the plan), and this could stop any development from happening, but - 3) the city council does not necesarily have to follow the recommendation of the planning commission, as it can be ignored if they so desire, and - 4) apparently three members of the city council (and i'm not sure which three) have gone on the record as being pro-development while one is against it, but i'm not sure about the others - 5) an open space organization like the trust for public land (or TPL) @ http://www.tpl.org/ could aquire a portion of the land for open space, and that would in theory make the rest of the land off limits to development / go to: http://www.tpl.org/ext_contact_us.cfm or email TPL @  webmaster@tpl.org and ask them to look at aquiring a portion of the peterson field for open space and/or wildlife habitat - 6) the saber cats football team was originally going to relocate elsewhere, but recent negotiations will keep them at the patrick henry property for the next two years minimum (fry's electronics owns the saber cats) - 7) there is no number seven right now, but if i think of one i will tell you...
