INCIDENT ON 11 JULY 2010 @ 2:20 AM

SLEEP DEPRIVATION = TORTURE: An incident which occurred 11 July 2010 @ 2:20 AM was video recorded by John. The short clip seen in the link below was created after John went outside in the middle of the night with his camera to capture the incident. John just happened to be awake right before the incident occurred; and heard a distant sound of honking and yelling; warning John that yet another night time disturbance was about to occur once again. NOTE: Even though Jake Paolinetti had sent John an email approximately one week after Johns' beloved cat Precious was found dead outside Johns' residence promising to stop his multi-year stalking/harassment/menacing/vandalizing etc campaign (see below + REST IN PEACE PRECIOUS @ http://addendumblog1.blogspot.com/2013/11/rest-in-peace-precious.html); Jake continued stalking and harassing and menacing etc John for roughly three years after with impunity due to negligent action on the part of the Santa Clara and/or Sunnyvale Police Departments. NOTE: Jake Paolinetti is clearly NOT entitled to the qualified immunity available to government officials; as the legal principle to bar Jakes' illegal and threatening conduct is clearly pre-established -- Also; no court has ever recognized a First Amendment right for ANY citizen to be free from retaliatory non-arrest with probable cause; nor was such a right otherwise clearly established at the time of Jakes' non-arrest -- And while it has been pre-established that government officials may not be sued under the First Amendment for retaliatory prosecutions where there was probable cause to pursue prosecution; the question remains whether government officials CAN be sued under the First Amendment for retaliatory non-prosecutions where there was probable cause to pursue prosecution.
