ON DECEMBER, 24TH 1999 JUST BEFORE 3 PM PDT; A SANTA CLARA, CALIFORNIA RESIDENT NAMED DANNY MATOS DROVE DANGEROUSLY AT AN EXTREMELY HIGH SPEED FROM POINT A TO POINT B FOR ROUGHLY 100+ MILES ALONG HIGHWAYS 101 and 152 BEFORE SLAMMING INTO JOHN'S BROTHER CARL AT 80+ MPH (THIS EVENT WAS WITNESSED BY SEVERAL PEOPLE). THE CALIFORNIA HIGHWAY PATROL (C.H.P.) IS GROSSLY NEGLIGENT FOR ALLOWING THIS TO HAPPEN; IN THAT THE CALIFORNIA HIGHWAY PATROL NOT ONLY FAILED TO APPREHEND MISTER MATOS ALONG A 100 MILE PLUS STRETCH OF HIGHWAY (WHICH CLEARLY LIES WITHIN C.H.P. JURISDICTION); BUT THEY ALSO APPARENTLY CAUSED THIS ACCIDENT BY ATTEMPTING TO APPREHEND MISTER MATOS AT THE LAST MINUTE!?!

Adding to this; nothing has been done to correct the dangerous situation at the point where the impact occurred along Highway 101 near the San Luis reservoir. The State of California and/or the California Highway Patrol is grossly negligent for some deaths that have occurred along this stretch of highway.

It is unconscionable to think that virtually no C.H.P. officers were along this stretch of highway 101; on such a high profile night as Christmas Eve when dangers such as drunk drivers etc were on the roadways. And the following may be part of current policy -- but in case it is not: any time a situation like this occurs where a backup in traffic could cause a major accident; there should be at very least two; if not 3 C.H.P. officers assigned to the backup in traffic. One officer should be stationed about 7-10 miles up the road from the backup to help visually deter speeders and/or apprehend excessive speeders; relaying information about excessive speeders to another officer closer to the traffic backup. This officer can perhaps apprehend any excessive speeders long before any backup in traffic (or perhaps a video camera can be attached to the side guard railing 7-10 miles from the backup; relaying speed information/evidence to officers further down the road; video evidence that can be later used to convict excessive speeders). And while no one wants to work on holidays; all rookie C.H.P. officers should be required to work holidays for the first 5 years of service to keep a sufficient number officers on the road at times when they are most needed.

"Here's the latest installment for anyone who think I'm paranoid or demented because I've been up weeks at a time chasing these bastards all over (and finding out after all this) that the asshole is located only about a 10 minute walk from my front door--yesterday, gateway went down--spent about 45 minutes on my own troubleshooting--stumped. Spent another 45 minute on the phone troubleshooting with tech guy--he says it's your telecom provider. I spent 3 hours on the phone with them yesterday getting jacked around--amgrier by the minute. And I've been catching verbal abuse, insults, called every name in the book by family members who don't know jack about computer security. First thing when the telecom guy gets here--he says the lines have been cut--I'M NOT FUCKING CRAZY!!! So called the police--police officer tried to give me the "stupid hysterical woman doesn't know what she's talking about". There have been other telecom people working on our street--not related to our issue. Some random guy suddenly appears, walking out of our BACK YARD and into the front where we are talking about the lines that were cut. I never saw this person near the trucks, never saw him get out of a truck and I ask for ID. Police start giving me crap and trying to say that company shirt and hat the guy is wearing and that he has a toolbelt and the trucks are there--means he works for the company. I say that company WARNS customers to demand to see company issued ID--if the guy has it, it should not be a problem. The cop and the "unidentified creep" had just about decided that we were "hysterical" and "inferior, and the men were taking care of it". About that time, LEGITIMATE repair guy show up and says "yes indeed these lines were cut" and the other guy mysteriously vanished--funny how seems to happen around here--dude was right there--caught red handed--wandered off--WTF exactly WAS he doing in our yard? ADDENDUM #16B) Jon Kinyon wrote on July 7: "It's been 6 days since my mom was brutally attacked just outside the front doors of the San Pablo Casino. The casino and the San Pablo Police have not talked with the media and still have not released video of the assailant. The only reason this news story was done was because I contacted KTVU myself." (Note: San Pablo police allegedly initially blamed Jon's mom for this sexual attack)

Jon Kinyon wrote on July 8: "INSULT TO INJURY: On top of everything we're going through, Stanford Medical Center treated us like we were trying to pull some kind of scam to get our mom free elderly care. Every step of the way they questioned everything we said, then gave us a lecture about how the "family needs to step up", take our mother home and provide care ourselves. They assumed that she had fallen and fractured her knee because she's old and that we were trying to game the system or something. They kept implying that she was faking her pain and wouldn't give here more pain medicine. When I told them she was a victim of a violent assault 3 days prior, the doctor asked incredulously, "And you made a police report, right? Right???" It went even further downhill from there with Stanford refusing to admit her "officially" and putting her in an observation room. ELDER ABUSE?

One very important aspect of this case is the fact that John's 90 year old father lives at the same residence where nearly a decade of stalking and harassment occurred; and this fact makes the case take on a new dimension of Elder Abuse. While the night time attacks were not necessarily all directed at John's elder father; Johns' elder father was nonetheless directly affected by these various disruptions; causing IMMENSE emotional distress for both John and his elder father, AND THIS IS UNACCEPTABLE. Note: Johns' father was admitted into Kaiser Hospital after the suspicious death of Precious Cat (click here). Also; Elder Abuse does not necessarily apply only to Johns' elder father -- this also applies to John and his lost wages and/or savings as well; as John is about 1 year away from being eligible for the Denny's restaurant senior menu (55+). This is not an advertisement for Denny's Restaurant.

TOM FOLEY @ THE LAKE TERRACE APARTMENTS: LAYING IN WAIT + CONSPIRACY ETC

Back in April of 2006; John was feeding ducks at the Lake Terrace Apartments (as John had done for a number of years with approval given at a City Council meeting by ex-Santa Clara Mayor Judy Nadler) when Lake Terrace resident Tom Foley jumped from behind a tree at the apartment complex and began a multi-week stalking and harassing campaign against John (see: Laying in wait -- Note: Tom Foley continued this campaign John for a number of weeks after this initial event -- see videos below -- and Tom Foleys' actions were allegedly premeditated) and Sunnyvale police responders simply let Tom Foley go after this initial attack; regardless of the evidence seen below:

John later spoke to Tom Foley and a lady who is now an ex-Manager of Lake Terrace apartments; where Tom Foley admitted to being put up to the attack by the owner of the apartment complex (the Lake Terrace owner also happens to be a lawyer) and this admission of guilt was also witnessed by one of Johns' friends. note: Tom Foley was later used at a City of Santa Clara administrative hearing on September 6th, 2007 as a "witness to duck feeding"; where John essentially had $235 dollars extorted from him; a hearing where Mister Olenak admitted to his attack on John in front of Judge Louis Amadeo Junior and approximately 7 other witnesses. John was given case number 06-03997 by Santa Clara officer Terrones for the 4-11-06 event (not EV06-10024 as stated in a falsified report by Officers Seagrave and Lopez). Also; there were two officers who responded to the 4-11-06 911 call made by John. These officers then went to the Lake Terrace Apartments to further investigate the attack on John by Tom Foley, which was reported by John to the responding officers. John was then informed by the officers that Tom Foley has a criminal record which the officers would not disclose. 

John later realized that Tom Foley was in fact at the Acapulco Restaurant with a group of friends from the Lake Terrace Apartments a few weeks before his initial April 2006 conspiratorial attack on John. One night Tom Foley followed John into the bathroom at the Acapulco Restaurant in a threatening fashion; but John did not realize what was going on until many months later when John finally put two and two together. This stalking and harassment by Tom Foley continued for a number of weeks after this initial April 2006 event; after being wrongfully let go by the Santa Clara police department after his initial attacks. 

Violence and/or intimidation and/or coercion on the part of Tom Foley amounts to a violation of Johns' Civil Rights that police are required to protect. This is just another example of a pattern of negligence over time and/or dereliction of duty on the part of local police responders.

NOTE: This whole episode started when John attended a Sunnyvale City Council meeting earlier in 2006 (as adjacent police agencies can and often do work in concert together to destabilize activists [etc] for each other). Shortly after John attended the 2006 Sunnyvale City Council meeting in question; the Santa Clara City Council proposed prohibiting feeding wildlife in Maywood Park; which was really just an official Santa Clara and/or Sunnyvale government way of creating a "good" reason to focus upon Johns' feeding of ducks (and/or activism); to then in turn destabilize Johns' activism. It started with Tom Foley's initial violent and/or coercive intimidation with premeditated and/or conspiratorial attacks (which backfired on Tom Foley and the Lake Terrace owner); then later morphed into the Lake Terrace owner trying unsuccessfully once again to stop John by sending two police Santa Clara officers to John's residence with an unlawful cease and desist order for feeding ducks. John was then wrongfully arrested and/or kidnapped and/or and/or falsely imprisoned by Pablo Lopez; then let go with no charges filed. Through these various actions; John's Civil Rights were egregiously violated in the process; which led to John filing a claim with the City of Santa Clara; which later turned into many years of harassment and stalking with the apparent blessings of now ex-Santa Clara police officer Don Paolinetti. Access to civil rights protection should not depend on government belief; as everyone should receive equal civil rights protection regardless. The latest troubling trend in (reverse etc) discrimination has opened a perilous loophole that enables law enforcement etc to ignore important common-sense laws that mandate equal protection for all—including and mainly important laws that protect against discrimination—based on the outdated beliefs of some within government.

While many Santa Clara County voters are not voting in today's election due to apathy; few if any are not voting due to having their Voting Rights violated as John had. VIOLATION OF THE VOTING RIGHTS ACT OF 1965 + RETALIATION AGAINST A WHISTLE BLOWER | 8 nov 2011 -- It appears some within the Sunnyvale police department essentially retaliated against a whistle blower (John) and also violated his voting rights -- for recently coming forward with information about a pending lawsuit -- By ordering John to stay off a property where John had to vote, and all due to the fact that John made a video which the Sunnyvale police department essentially sanctioned through Officer Odle (The video is of a Peterson Middle School employee mowing the lawn > go to: http://www.youtube.com/watch?v=Bbd21_NC8_k) The information gained was CLEARLY in the public interest; regardless of the opinion of unelected judges.
